WRKBYBLU Policies & Terms

Booking & Payment:
A signed agreement and a non-refundable 50% deposit are required to secure any photography session, design project, or creative service booking. Dates, project timelines, and services are not reserved until both the signed agreement and deposit have been received.
Unless otherwise agreed upon by both parties in writing, all invoices must be paid by the due date stated on the invoice.
Final deliverables, galleries, designs, files, and project materials will not be released until all outstanding balances have been paid in full.
WRKBYBLU reserves the right to pause work, withhold deliverables, or cancel services for unpaid balances.
Deposits:
All deposits are applied toward the total project cost and secure the scheduled service date or project slot.
Deposits are non-refundable unless otherwise agreed upon in writing by both parties.
Cancellations & Rescheduling:
Clients may request to reschedule a photography session or service with at least 24 hours' notice, subject to availability.
Cancellations made less than 24 hours before the scheduled service may result in forfeiture of the deposit.
No-call, no-show appointments are considered abandoned bookings and are not eligible for refunds, credits, or rescheduling.
WRKBYBLU reserves the right to approve or deny rescheduling requests based on availability.
Photography Services:
Photography services include only the services, deliverables, editing, and products outlined in the selected package unless additional services, deliverables, products, or add-ons are agreed upon in writing by both parties. Additional requests may be subject to additional fees.
WRKBYBLU retains full creative discretion regarding image selection, editing style, color grading, retouching, cropping, and final presentation.
Raw or unedited images are not included unless otherwise agreed upon in writing.
Turnaround times may vary depending on project scope, workload, holidays, revision requests, or unforeseen circumstances.
Graphic Design Services:
Graphic design services include only the deliverables outlined in the approved proposal, invoice, package, or agreement unless additional services, deliverables, revisions, project scope changes, or add-ons are agreed upon in writing by both parties. Additional requests may be subject to additional fees.
Concepts, drafts, unused designs, and working files remain the property of WRKBYBLU unless otherwise agreed upon in writing.
Clients are responsible for reviewing and approving all final designs before publication, printing, distribution, manufacturing, or production.
WRKBYBLU is not responsible for errors discovered after final approval has been granted.
Revisions:
Projects include the number of revisions specified within the selected package or proposal.
Additional revisions beyond those included may incur additional fees.
Significant changes to approved concepts, project direction, or previously completed work may be considered a new project and billed accordingly
Turnaround Times:
Estimated delivery timelines are provided as estimates and are not guaranteed.
Delays may occur due to client communication delays, incomplete project information, revision requests, technical issues, holidays, emergencies, or circumstances beyond WRKBYBLU's control.
Clients are responsible for providing requested materials, approvals, and feedback in a timely manner.
Client Responsibilities:
Clients agree to provide accurate information, necessary materials, approvals, and communication required to complete the project.
WRKBYBLU is not responsible for delays caused by late responses, missing information, incomplete submissions, or failure to provide requested materials.
Usage Rights & Creative Ownership:
Upon full payment, the Client is granted the right to use the final delivered photographs, designs, and creative assets for their intended personal or business purposes.
Ownership of original source files, raw photographs, working files, drafts, concepts, and unused materials remains with WRKBYBLU unless otherwise agreed upon in writing.
Clients may not claim authorship of WRKBYBLU's work.
Clients may not resell, redistribute, sublicense, alter, or commercially exploit deliverables beyond their intended use without prior written permission from WRKBYBLU.
Portfolio & Promotional Use:
WRKBYBLU reserves the right to display completed work, including photographs, designs, project deliverables, and related materials in portfolios, websites, social media platforms, marketing materials, publications, competitions, advertisements, and promotional content.
Clients requiring confidentiality must request such arrangements in writing prior to the start of the project.
Creative Direction:
WRKBYBLU maintains creative discretion throughout all projects while considering client feedback within the agreed revision limits.
Final decisions regarding artistic style, editing, design execution, layout, composition, typography, color treatment, and overall presentation remain at the discretion of WRKBYBLU.
Limitation of Liability:
WRKBYBLU shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of services or deliverables.
WRKBYBLU's maximum liability shall not exceed the total amount paid by the client for the specific service provided.
Force Majeure:
WRKBYBLU shall not be held responsible for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, illness, equipment failure, internet outages, government restrictions, venue issues, transportation delays, or other unforeseen events.
Right to Refuse Service:
WRKBYBLU reserves the right to refuse, cancel, or terminate services for any project involving unlawful activity, harassment, discrimination, abusive behavior, unsafe working conditions, or violations of these terms.
